I. General Terms and Conditions
§ 1 Basic provisions
(1) The following terms and conditions apply to contracts that you conclude with us as a provider (Francesco Palmieri) via the website www.palmieri-golftour.de or via other means of distance communication. Unless otherwise agreed, the inclusion of any of your own terms and conditions is hereby excluded.
(2) A consumer within the meaning of the following provisions is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity. An entrepreneur is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their independent professional or commercial activity.
§ 2 Subject of the contract
(1) The subject of the contract is participation in the PALMIERI GOLF TOUR, 18-hole amateur tournament series. The PALMIERI GOLF TOUR consists of several tournaments at different locations. The individual tournaments are organized by the respective local golf club (partner club). You can find more information on our website, especially in the tour calendar at https://www.palmieri-golftour.de/kalender.
(2) The participation fee for the PALMIERI GOLF TOUR is €19.90 per calendar year. This fee is to be paid to us.
(3) For each qualifying tournament, a fee of €55/€75 (18 holes) (event fee) will be charged, which you must pay directly to us.
(4) You will receive a tour card (PALMIERI GOLF CARD) by post to identify you as a PALMIERI GOLF TOUR player for the current calendar year.
The tour card is not transferable. It must be presented to the organizing golf club at each tournament in order to participate in the tournament.
Alternatively, you can present the registration confirmation we sent to the local golf club as proof of eligibility to participate. If your name is included in the starter/results list on our website (www.palmieri-golftour.de/ergebnisse), it is also sufficient to present an official ID document.
(5) After full payment of the participation fee for the current calendar year, you will be listed in the starter/results list on our website (www.palmieri-golftour.de/ergebnisse) within approximately 3 - 5 days and will be able to participate in the tournaments listed there at a reduced tournament fee.
(6) By presenting the tour card to local golf clubs, you can claim any discounts or special services offered by these golf clubs. Whether such discounts or special services are offered is solely at the discretion of the respective golf clubs. Information on this can be obtained from the golf clubs.
§ 3 Conclusion of the contract
(1) Our offers on the Internet are non-binding and do not constitute a binding offer to conclude a contract.
(2) You can send us inquiries about registration for the PALMIERI GOLF TOUR using the inquiry form integrated on our website (www.palmieri-golftour.de/kontakt) or by telephone, email or post.
Your enquiries are non-binding.
We will make you a binding offer in text form (e.g. by email), which you can accept within 5 days (unless another deadline is specified in the respective offer) by binding registration.
(3) After acceptance of the offer (and thus conclusion of the contract) and full payment of the participation fee, you will receive another registration confirmation from us by email.
§ 4 Contract term, termination
(1) The contract concluded between you and us has a term of one year (from the date of conclusion of the contract until August 31 of the same or following year).
If the contract is not terminated by one of the parties in writing (e.g. e-mail) 1 month before the end of the contract, it will be tacitly extended for a further year.
(2) The right to terminate the contract without notice for good cause remains unaffected.
§ 5 Provision of services, conditions of participation
(1) The service will be provided in the form described in the respective offer and on the agreed dates.
(2) Any natural person who has reached the age of 14 can take part in the PALMIERI GOLF TOUR. For participants under the age of 18, the consent of a parent or legal guardian is required.
(3) The transfer of the tour card (PALMIERI GOLF CARD) to third parties is not permitted.
(4) You are obliged to provide truthful information when registering. You must inform us immediately of any changes to the data required to fulfil the contract.
§ 6 Right of retention
You can only exercise a right of retention if it concerns claims arising from the same contractual relationship.
§ 7 Choice of law
(1) German law applies. In the case of consumers, this choice of law only applies to the extent that it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which he or she is habitually resident (favorability principle).
(2) The provisions of the UN Convention on Contracts for the International Sale of Goods shall expressly not apply.

2. Information on the conclusion of the contract
The contract is concluded in accordance with the provision “Conclusion of the contract” of our General Terms and Conditions (Part I).
3. Contract language, contract text storage
3.1 The contract language is German.
3.2. We do not store the complete contract text.
You will receive all contract data as part of a binding offer in text form, e.g. by email, which you can print out or save electronically.
4. Essential characteristics of the service
The essential features of the service can be found in the respective offer.
5. Prices and payment terms
5.1. The prices stated in the respective offers represent total prices. They include all price components including all applicable taxes.
5.2. We do not charge any shipping costs for sending the tour map.
5.3. You have the following payment options, unless otherwise stated in the respective offer: Payment by invoice.
5.4 Unless otherwise stated in the respective offer or invoice, the payment claims arising from the concluded contract are due for payment immediately.
6. Delivery conditions for the tour card (PALMIERI GOLF CARD)
6.1. The tour map will only be delivered within Germany.
6.2. After full payment of the participation fee, you will receive the tour card for the current calendar year by post within approximately 10 days. Please note that no deliveries are made on Sundays and public holidays.
For all subsequent calendar years, you will receive the tour card by post by the end of December of the respective calendar year after full payment of the participation fee.
7. Statutory liability for defects
The statutory liability for defects applies.
8. Contract term, termination
Information on the term of the contract and the termination conditions can be found in the "Contract term, termination" provision in our General Terms and Conditions (Part I), as well as in the respective offer.

Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The cancellation period shall be fourteen days from the date of conclusion of the contract.
To exercise your right of withdrawal, you must inform us (Francesco Palmieri, Reinhold Langenberger Weg 1, 85221 Dachau, telephone number: 08131 3320950, fax number: 08131 3320933, email address: anmeldung@palmieri-golftour.de) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or email). You can use the attached sample withdrawal form for this purpose, but this is not mandatory.
To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.
Consequences of revocation
If you cancel this contract, we will refund all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund.
If you have requested that the services begin during the cancellation period, you must pay us an appropriate amount corresponding to the proportion of the services already provided up to the point at which you notify us of the exercise of the right of cancellation with regard to this contract compared to the total scope of the services provided for in the contract.
Reasons for termination
The right of withdrawal expires in the case of a contract for the provision of services if the entrepreneur has fully provided the service and has only started to perform the service after the consumer has given his explicit consent and at the same time confirmed his knowledge that he will lose his right of withdrawal if the entrepreneur fully performs the contract.
